Terms of Service

1. Acceptance

By creating a Tutorika account, you fully agree to these Terms of Service and to our Privacy Policy, which is an integral part of this document. If you do not agree with any provision, please do not use the platform. These terms form a contract between you and Tutorika and apply to all features, versions, and access channels of the service.

2. Registration and eligibility

To use Tutorika you must be at least 18 years old and legally able to enter into contracts. You are responsible for keeping your registration data accurate and for safeguarding your access credentials. Access is personal and non-transferable; any activity on your account is your responsibility. Notify us immediately of any unauthorized use.

3. Permitted use

Tutorika is intended exclusively for private tutors to manage their scheduling and students. It is prohibited to:

• Send unsolicited messages (spam) or messages that violate WhatsApp's policies;
• Share account access with unauthorized third parties;
• Attempt to bypass plan limits, reverse-engineer, or overload the infrastructure;
• Use the platform for illegal purposes or in violation of third-party rights.

4. Content responsibility

You are responsible for the data you enter (student information, messages sent) and represent that you have a legal basis to process it. In your relationship with your students, you act as the controller of that data and Tutorika as the processor, under Brazil's data protection law (LGPD). Tutorika is not responsible for content submitted by users or for the commercial relationship between tutor and student.

5. Intellectual property

The Tutorika brand, software, interface, and all materials are owned by or licensed to us and protected by applicable law. These terms grant you a limited, non-exclusive, revocable license to use the service, without transferring any intellectual property rights. The data you enter remains yours.

6. Third-party integrations

Tutorika relies on third-party services to operate, such as messaging (WhatsApp) and email providers. Use of these integrations is also subject to the terms of the respective providers. We are not liable for outages, policy changes, or failures caused by these external services.

7. Plans and billing

New accounts get a free 30-day trial, no credit card required. Paid plans are billed monthly in advance. Cancellations take effect at the end of the current billing cycle, and you keep access until the end of the period already paid. We do not refund paid periods except where required by law. In case of non-payment, the account may be suspended after the grace period shown in the dashboard.

8. Suspension and termination

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation. You may close your account at any time. After termination, your data is handled according to the Privacy Policy and the minimum retention required by law.

9. Limitation of liability

Tutorika is provided "as is." We do not guarantee uninterrupted or error-free availability. Our liability for direct damages is limited to the amount paid in the last 3 months of subscription, and we are not liable for indirect damages, lost profits, or data loss arising from the use or inability to use the platform.

10. Data protection

The processing of personal data follows our Privacy Policy and Brazil's General Data Protection Law (LGPD). We apply technical and organizational measures to protect information and never sell student or tutor data.

11. Changes to terms

We may update these terms periodically. We will notify you by email at least 30 days in advance for material changes. Continued use after the effective date implies acceptance.

12. Governing law

These terms are governed by Brazilian law. The courts of São Paulo, Brazil are the exclusive jurisdiction for any disputes.
